We are very pleased and excited to be one of the very few, if not the only, tree care company in north metro Atlanta to be 100% compliant with Federal and State (Georgia) law regarding our labor practices. You have our guarantee that A Southern Tree does not use undocumented/illegal workers. Our labor is verifed legal to work in the United States through the national E-Verify system.

In 2011, Gov. Nathan Deal signed HB 87.  Among other things, this law requires Georgia business to use the federal E-Verfiy program to determine whether their new hires are eligible to work legally in the United States.  This requirement will be phased in, and eventually require businesses between 11 and 99 employees to comply by July 1, 2013.

Why This Matters For Our Customers

Many tree care companies – particularly in the Roswell and Alpharetta areas – use undocumented/illegal workers. While this significantly cuts costs for the company, it introduces some problems for the client.

  • It hurts the local economy. It takes jobs away from legal residents and earned money is usually sent out of the local area .
  • The customer assumes risk. If the company claims to have worker’s compensation coverage, the fact is that undocumented workers are NOT covered. Worker’s comp premiums are based on reported payroll – undocumented workers by definition cannot be reported. If an undocumented worker is injured (or is killed) on your property, YOU are ultimately liable.

What You Must Do

“Buyer Beware” definitely applies in this case. Tree care is one of the most dangerous professions in the world with monthly reports of serious injury and death.  In order to protect yourself from individual injury/death on your property, you must do the following when validating any tree care company’s credentials:

  1. Ask that they provide a written guarantee that no undocumented workers will be on your property. Remember, Undocumented Workers = No Worker’s Comp Coverage for those workers.
  2. Upon receiving their WC certificate, call the insurance company to verify either reported payroll or number of individuals on the policy. A typical crew is 3-4 individuals, so payroll less than $70,000-$100,000 would be a big red flag.
